Terms of Service

These Terms of Service ("Terms") are an agreement between the Shopify merchant who installs Joy Search ("you") and Joykek Dijital Reklam ve Pazarlama Danışmanlık Hizmetleri Ltd. Şti. ("Joykek", "we"). By installing or using the app you accept these Terms and our Privacy Policy. If you do not agree, do not install or use the app.

Joy Search is a Shopify application that provides storefront product search and discovery (instant search panel, typo tolerance, filters, sorting, voice search), merchandising tools (boost, pin, sequence rules, synonyms, redirects, banners, exclusions), learning ranking and analytics including sales attributed to search through a Shopify Web Pixel. The storefront part is delivered as a Theme App Extension; the admin part runs embedded in Shopify admin. Features vary by plan as listed on the Pricing page and inside the app.

• You must own or be authorized to manage the Shopify store on which you install the app.
• Access to the app is controlled by your Shopify staff permissions; you are responsible for the actions of your staff.
• You grant Joy Search the access scopes shown at installation. All catalog scopes are read-only; the app requests no access to orders, customers or the checkout.
• You are responsible for the accuracy of the catalog data, rules and texts you enter.

• Joy Search is offered as a monthly subscription in three plans: Starter (USD 15/month), Growth (USD 39/month) and Pro (USD 99/month).
• Every plan begins with a 14-day free trial during which all features are available. You are not charged until the trial ends.
• Fees are billed through the Shopify Billing API and appear on your Shopify invoice. Shopify's payment terms apply.
• You may upgrade, downgrade or cancel at any time from the Plan page in the app or by uninstalling. Changes take effect according to Shopify's billing cycle rules; cancellation stops future charges and no refund is issued for the current period unless required by law.
• Prices exclude any taxes that Shopify or your jurisdiction may add.

• Each plan includes a product limit (Starter 2,000; Growth 25,000; Pro unlimited) and a monthly search limit (Starter 25,000; Growth 150,000; Pro 500,000).
• If you exceed the monthly search limit, storefront search keeps working. We notify you in the app and by email and ask you to move to a higher plan. Sustained overuse without upgrading may lead to reduced analytics retention or, after notice, suspension of the subscription.
• Plan prices are fixed and do not depend on your revenue. We will not increase the price of an existing subscription without at least 30 days' notice inside the app or by email; you may cancel before the change takes effect.

You agree not to:

• Use the app in violation of Shopify's Terms of Service, Acceptable Use Policy or applicable law.
• Attempt to extract, scrape or export the search index other than through the features provided, or to use the scoped search key outside your own storefront.
• Reverse engineer, copy, resell or sublicense the app or its storefront script.
• Use merchandising features to deceive shoppers (for example hidden redirects to unrelated pages).
• Interfere with the operation of the service or with other merchants' stores.

Joy Search, including its code, design, storefront script, documentation and trademarks, is owned by Joykek. You receive a limited, non-exclusive, non-transferable license to use the app on your Shopify store for the duration of your subscription. Your catalog, rules, texts and brand assets remain yours; you grant us the license needed to index and display them through the app.

The app depends on Shopify (Admin API, Billing API, Theme App Extensions, Web Pixels) and on our hosting providers listed in the Privacy Policy. We are not responsible for changes, outages or policies of these third parties. Shopify's terms govern your relationship with Shopify.

The app is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that search results will meet every expectation, that the service will be uninterrupted or error-free, or that any particular increase in sales will occur.

To the fullest extent permitted by law, Joykek shall not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the app. Our total liability for any claim arising out of these Terms shall not exceed the subscription fees you paid to Joykek for the app in the three months preceding the claim.

You agree to indemnify and hold harmless Joykek from claims, damages and expenses (including reasonable legal fees) arising from your catalog content, your merchandising rules, your violation of these Terms or of applicable law, or your violation of third-party rights.

• You may terminate at any time by uninstalling the app. Your index and data are deleted within 48 hours as described in the Privacy Policy.
• We may suspend or terminate access with notice if you materially breach these Terms, if required by Shopify or by law, or if the subscription remains unpaid.
• Sections 7, 9, 10, 11, 14 and 15 survive termination.

Support is provided by email at info@joykek.com in English, Turkish, German, Spanish and Arabic. We aim to answer within one business day; Pro plan requests are handled first. The setup guide is available inside the app and on this website.

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the jurisdiction of the courts and enforcement offices of İstanbul (Anadolu). Nothing in this section limits mandatory consumer or data protection rights you may have in your own jurisdiction.

• These Terms and the Privacy Policy are the entire agreement between you and Joykek regarding the app.
• If any provision is found unenforceable, the remainder stays in effect.
• We may update these Terms; material changes are announced in the app or by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.
• You may not assign these Terms without our consent; we may assign them to a successor of the app.
